Privacy policy

What happens to personal data when you visit this website or send us an enquiry.

1. Controller

The controller within the meaning of the General Data Protection Regulation (GDPR) is:

VERTEX GmbH
Bogenstraße 15
47799 Krefeld, Germany
Managing director: Evgeny Stein
Telephone: +49 2151 649 73 97
Email: purchasing@vertex-group.de

2. Principles

We process personal data only where there is a legal basis for doing so, and only to the extent necessary. This website is deliberately built without tracking: it sets no cookies, uses no analytics services, embeds no social media plug-ins and loads no fonts, scripts or images from third-party servers. Everything this site needs is delivered from our own web address.

3. Server log files

When you access this website, your browser transmits technical information that is recorded by the web server in log files. This is normally:

  • the IP address of the requesting device,
  • the date and time of the request,
  • the address of the page or file requested,
  • the HTTP status code and the volume of data transferred,
  • the referring address, if transmitted by your browser,
  • the browser type and version and the operating system used.

The legal basis is Article 6 (1) (f) GDPR. Our legitimate interest is to deliver the website reliably, to maintain the security and stability of the systems, and to be able to investigate misuse. This data is not merged with other data sources and is not used to identify individual visitors. Log data is deleted or anonymised as soon as it is no longer required for these purposes.

4. Hosting

This website is hosted by Cloudflare Germany GmbH, Rosenheimer Straße 143C, 81671 München. The hosting provider processes the data described above on our behalf as a processor within the meaning of Article 28 GDPR, on the basis of a data processing agreement concluded with us.

The hosting provider operates a global server network, so data may also be processed outside the European Union. This is based on the European Commission's standard contractual clauses, which form part of the data processing agreement.

5. Contacting us

If you contact us by email or telephone, the information you provide — including your name, company, contact details and the content of your enquiry — is processed in order to deal with that enquiry and any follow-up questions.

Where the enquiry relates to the conclusion or performance of a contract, the legal basis is Article 6 (1) (b) GDPR. In all other cases the legal basis is Article 6 (1) (f) GDPR, our legitimate interest in responding to enquiries addressed to us.

We retain this data for as long as it is needed to process the enquiry and the business relationship arising from it. Statutory retention obligations under commercial and tax law — regularly six or ten years — remain unaffected; for as long as they apply, processing is restricted to that purpose.

6. Technical enquiry form

The form at vertex-group.de/en/enquiry/ lets you send us a technical enquiry. We process the details you enter there: application and industry, the gases to be monitored, the hazardous area zone, the type of use, quantity, timescale, whether an installation already exists, the services required, any product reference, and your company, contact name, email address, telephone number and message. We also record which page and which language version the enquiry was sent from.

The legal basis is Article 6 (1) (b) GDPR where the enquiry concerns the conclusion or performance of a contract, and otherwise Article 6 (1) (f) GDPR, our legitimate interest in answering enquiries addressed to us. The email address and company name are needed in order to attribute and answer the enquiry; every other field is optional.

To protect against automated submissions the form contains a hidden field that a person does not fill in. No captcha service is used and the form sets no cookies.

To deliver the form message to our mailbox we use Resend as a processor within the meaning of Article 28 GDPR (Resend, Inc.), on the basis of a data processing agreement and the EU standard contractual clauses. The form data is additionally stored with the hosting provider of this website so that we can trace what was received.

We retain the details for as long as they are needed to deal with the enquiry and the business relationship arising from it. Statutory retention obligations remain unaffected.

7. Enquiry measurement

We count how many enquiries arrive through the form and how many of them meet the agreed technical criteria, broken down by month. The counter itself contains no personal data, only totals. The legal basis is Article 6 (1) (f) GDPR, our legitimate interest in measuring the performance of our own website. No web analytics service is used.

8. Recipients of the data

Personal data is passed on only where this is necessary to perform a contract, where we are legally obliged to do so, or where you have consented. Within our organisation, access is limited to the people who need the data to perform their tasks — for example sales, technical support and accounting. A transfer of personal data to countries outside the European Union or the European Economic Area does not take place for the operation of this website.

9. Your rights

Under the GDPR you have the right to:

  • obtain confirmation as to whether we process your data and to access it (Article 15 GDPR),
  • have inaccurate data corrected (Article 16 GDPR),
  • have data erased (Article 17 GDPR),
  • have processing restricted (Article 18 GDPR),
  • receive the data you provided in a structured, machine-readable format (Article 20 GDPR),
  • object at any time to processing based on Article 6 (1) (f) GDPR, on grounds relating to your particular situation (Article 21 GDPR).

To exercise these rights, write to purchasing@vertex-group.de or to the postal address given above.

10. Right to lodge a complaint

You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or the place of the alleged infringement. The authority competent for VERTEX GmbH is:

Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen
Postfach 20 04 44, 40102 Düsseldorf, Germany
Telephone: +49 211 38424-0
Email: poststelle@ldi.nrw.de

11. Obligation to provide data

You are not obliged to provide personal data. However, without the technical data described in section 3 the website cannot be delivered to your device, and without contact details we cannot answer an enquiry.

12. Automated decision-making

We do not use automated decision-making, including profiling, within the meaning of Article 22 GDPR.

13. Changes to this policy

We update this privacy policy when the processing described here changes. The version currently in force is always the one published on this page.
